The responsibility for network modernization depends on the terms agreed upon at the time of connection release to the society:
1. Single-Point Connection: If the department sanctioned a single bulk connection for the society, the builder or the Apartment Owners' Association (AOA) manages the internal electricity distribution. In this case, the developer/AOA is responsible for network modernization.
2. Multi-Point Connection: If individual residents receive electricity connections directly from the department, there are three possible scenarios:
- Department Responsibility: The department handles network modernization if the internal infrastructure was developed by or under the supervision of the department and handed over to them upon completion.
- Builder/AOA Responsibility: The builder/AOA is responsible if the internal infrastructure was developed independently and not handed over to the department.
- Guarantee Period Clause: In some cases, there may be a guarantee period (e.g., 3-5 years) during which the builder/AOA maintains the infrastructure, such as transformers and switching systems, before transferring responsibility to the department.
The specifics can be clarified by reviewing the agreement and terms and conditions established during the connection release process.
